Terms of Service

These Terms of Service (the “Terms”) constitute a binding agreement between IQ School of Finance (the “Institute”) and each individual granted access to the MQ Testing Portal (the “Portal”). By accessing the Portal, the user signifies unconditional acceptance of these Terms. Users who do not accept these Terms must refrain from accessing the Portal.

1. Eligibility and Grant of Access

Access to the Portal is granted at the sole discretion of the Institute to candidates duly enrolled in its examination preparation programmes. No facility for self-registration is provided. Credentials are issued directly by the Institute and confer a personal, non-exclusive, non-transferable and revocable licence to access the Portal solely for the user's own preparation. No other right or interest is conferred.

2. Account Security and Single-Device Restriction

The user is solely responsible for maintaining the confidentiality of the credentials issued to them and for all activity conducted through their account, whether or not authorised by them. The user undertakes to notify the Institute without delay upon becoming aware of any unauthorised access.

Each account is bound to the device from which the user first signs in. Any subsequent attempt to access the account from a different device will be refused until the binding is reset by the Institute. Repeated requests for reset, or any pattern of access indicating that credentials have been shared, may result in the suspension or termination of the account without refund or further recourse.

3. Permitted Use

The user shall not, and shall not permit any other person to:

• disclose, share, sell or otherwise transfer their credentials to any third party;
• reproduce, republish, distribute, transmit or make available any past paper, answer key, feedback report or other material obtained through the Portal, whether for consideration or otherwise;
• employ any automated means, including scripts, crawlers or scraping tools, to access the Portal or extract content from it;
• attempt to circumvent, disable or otherwise interfere with any security, authentication or access-control feature of the Portal;
• upload any file containing malicious code, or any file that is not a bona fide answer script submitted in respect of the relevant paper; or
• use the Portal in any manner that is unlawful or that may impair its operation or availability to other users.

4. Submissions and Assessment

Each paper may be attempted once. Answer scripts must be submitted in the format prescribed for the relevant subject and must not exceed the file size limit stated at the point of submission. A submission, once made, cannot be withdrawn, replaced or amended.

The user warrants that each answer script submitted is their own original work, prepared without impermissible assistance. The Institute reserves the right to decline to assess, and to disregard, any submission which in its reasonable opinion is not the user's own work, is illegible, is incomplete, or does not correspond to the paper against which it was submitted.

Examiner feedback is issued by electronic mail to the address registered against the user's account. Marks and grades are not displayed within the Portal. The timing of the issue of feedback is determined by the Institute and no guarantee is given as to any particular turnaround period.

5. Intellectual Property

All past papers, answer keys, marking schemes, lecture materials, study plans, feedback templates and other content made available through the Portal, together with the design, structure and software comprising the Portal itself, remain the exclusive property of the Institute or of its licensors. Nothing in these Terms operates to transfer any such right to the user.

The user retains ownership of the answer scripts they submit, and grants the Institute a non-exclusive, royalty-free licence to store, reproduce and process such scripts to the extent necessary for the purposes of assessment, the preparation of feedback, and the maintenance of academic records.

6. Availability

The Portal is made available on an “as is” and “as available” basis. The Institute does not warrant that access will be uninterrupted, timely or free from error, and reserves the right to suspend access, in whole or in part, for maintenance, upgrade or any other operational reason, whether or not notice is given.

7. Limitation of Liability

To the fullest extent permitted by law, the Institute shall not be liable for any indirect, incidental, special or consequential loss, nor for any loss of data, loss of opportunity or examination outcome, howsoever arising from the use of or inability to use the Portal. Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.

8. Suspension and Termination

The Institute may suspend or terminate access to the Portal, with immediate effect and without prior notice, where it reasonably considers that the user has breached these Terms, that credentials have been shared, or that continued access would be prejudicial to the integrity of its programmes or to other users. Clauses 5, 7 and 10 survive termination.

9. Amendment

The Institute may amend these Terms from time to time. The version published on the Portal shall constitute the Terms in force, and the date of last revision is stated at the head of this document. Continued use of the Portal following any such amendment constitutes acceptance of the Terms as amended.

10. Governing Law

These Terms are governed by and shall be construed in accordance with the laws of the Islamic Republic of Pakistan, and the courts of Karachi shall have exclusive jurisdiction in respect of any dispute arising out of or in connection with them.
